Dock & Seawall Permits on the Space Coast: A Plain-English Guide

Who needs to sign off before a dock, lift or seawall goes in on the Indian River Lagoon or the Banana River.

The Layers of Approval

Most waterfront jobs in Brevard County touch more than one approval. Which ones apply depends on the structure, the water it sits over, and who has jurisdiction on your address.

  • Local building permit — from Brevard County, or the city your property is in (Cocoa, Cocoa Beach, Melbourne, Titusville, Rockledge and others each issue their own).
  • State environmental review — the Florida Department of Environmental Protection and the St. Johns River Water Management District cover work in or over state waters. Some small private docks qualify for exemptions; many projects still need review.
  • State submerged-lands authorization — a dock usually sits over state-owned bottomland, so authorization to use it may be required, and special rules apply inside the aquatic preserves.
  • U.S. Army Corps of Engineers — federal authorization for work in navigable waters, often through a general permit for smaller private structures.

What Slows Permits Down

  • Seagrass or other protected habitat in front of the property
  • Manatee protection conditions for in-water work
  • Plans that do not match the survey
  • Lot lines and riparian-rights questions with neighbors
  • Missing drawings or unclear scope

Seawalls Are Different From Docks

Replacing a seawall in place is treated differently from moving the wall waterward, and repair is treated differently from replacement. A wall built farther out into the water draws more scrutiny. We tell you up front which category your job falls into.

How long does permitting take?

It varies by agency workload and project type. Simple jobs can move in weeks, and anything touching protected habitat can take months. We give you a realistic window after the site visit.

Who files the permit paperwork?

We coordinate the applications for the jobs we build, so you are not left dealing with agencies on your own.

Do I need a permit to repair a dock?

Sometimes. Like-for-like repairs are treated differently from expansion or replacement, but the line is not always obvious. Ask before starting, because unpermitted work can be ordered removed.
